Service Agreement
This agreement is between 99main Internet Services, LLC (hereinafter known
as "99main") and Subscriber (as stated on the registration form). It contains
the terms and conditions under which a subscriber may register as a new user
with 99main. All subscribers must agree with and adhere to the following:
- 99main will provide full PPP dial-up access to the Internet for its
registered subscribers. There will be a flat monthly fee for this service
which will be determined according to the subscriber's individual
requirements.
- 99main reserves the right to amend this Service Agreement and/or rate
schedule at any time. Current pricing and/or any changes or amendments will
be published on the service (http://www.99main.com/tos.shtml)
- 99main offers no warranties or guaranties, whether written, oral or
implied, with respect to the service provided. Subscribers agree to accept
the service "as is". 99main will not be liable for any damages claimed by a
subscriber as a result of the use of this service. Subscribers will be
liable for any damages that result from violations of the service agreement
and/or the acceptable use guidelines hereinafter set forth.
- Individual subscribers must be 18 years of age or older. A parent and/or
legal guardian may register for a subscriber who is under the legal age.
Please note: 99main is not responsible for monitoring or restricting access
to the service by a registered subscriber.
- Subscribers will be billed in advance on a monthly basis, and payments
by check, money order, cash and credit card are accepted. For check, cash or
money order payments, invoices will be sent via E-mail on the 15th day of
every month and payment is due by the 1st day of the following month.
Subscribers who wish to receive invoices via the Postal Service will be
charged an additional $2.00 per month for handling. For subscribers who
elect to pay by credit card, invoices will be generated and accounts will be
credited on the 1st business day of every month. Any account which is 30
days past due will be charged a minimum $2.00 finance charge per month until
paid in full, and, unless special arrangements are made, the subscriber will
be denied access to the service until the arrearage is paid. A $20.00
"reconnect fee" will be charged when the account is reinstated. If a
subscriber tenders a check that is returned for nonpayment, or if his/her
credit card is declined, the subscriber will be denied access to the
service, and an administrative fee of $20.00 will be assessed. In addition,
the $20.00 reconnect fee as described above will be charged. If an overdue
account is referred to our collection agency, all costs of collection will
be added to the overdue amount. If subscriber supplies credit card
information for billing purposes at any time during the service term, 99main
reserves the right to process said card for any final balance due that
remains unpaid after the account is closed.
- 99main reserves the right to terminate access to the service of any
subscriber who has been deemed by 99main to have violated any of the terms
and conditions of this agreement and/or the acceptable use guidelines set
forth herein. Any inappropriate use of the service will not be tolerated.
99main will notify the subscriber in writing of any suspension of rights.
All subscribers to the service agree to abide by the acceptable use
guidelines for the service as published herein.
- 99main will not be responsible for subscriber files stored on the
service. It is the responsibility of the subscriber to perform any back ups
that are necessary.
- 99main reserves the right to inspect and review any information that is
made available to the public (i.e. Home Pages), and if such information is
deemed inappropriate, 99main may, at its sole discretion, remove said
information. 99main will notify subscriber in writing of any such action.
- Subscribers wishing to terminate their accounts with 99main must give 30
days' notice, and submit the request in writing. Failure to submit the
request in writing will result in additional billing to the account. There
will be no refunds given to accounts that have been pre-paid. Any fees paid
to 99main for hardware is non-refundable.
- Subscribers are requested to sign this Service Agreement and return it
to 99main within 30 days from the date of activation of the account. Failure
to sign this agreement will not negate the terms contained herein. Use of
the services provided by 99main will constitute your acceptance of this
agreement.
- This agreement shall be governed by the laws of the State of
Connecticut.

Acceptable Use Policy
The guidelines listed below are designed to help subscribers use the Internet to its full potential. Subscribers are asked to use modicums of decorum when using the service provided by 99main. Please note: 99main reserves the right to terminate service to any subscriber who violates one or more of the guidelines listed below.
- 99main will not and cannot monitor or referee all activity that occurs on the service. However, subscribers are asked to respect the ideas and opinions of others on the service and on the Internet. 99main will intervene only when it is deemed necessary to ensure the quality of the service provided.
- The use of appropriate language is recommended.
- Do not use the service for inappropriate commercial use. The personal accounts that are available to subscribers are designed for non-commercial, casual use. If a more extensive plan is needed to meet certain business requirements, subscribers are asked to contact the 99main support staff for help.
- 99main reserves the right to amend this Service Agreement and/or rate schedule at any time. Current pricing and/or any changes or amendments will be published on the service (http://www.99main.com/dsltos.shtml).
- Any form of fraudulent or abusive behavior will result in the termination of the subscriber’s account. This includes E-Mail harassment and/or forgery, hacking, spamming (bulk posting to newsgroups or large amounts of individual E-mail), annoying chain letters and/or pyramid schemes, and the like.
- 99main's E-mail server is not intended for long term storage of E-mail messages. Each mailbox on our server has a maximum limit of 30MB and a long term storage limit of 5MB (longer than 20 days.) If these limits are exceeded, delivery of mail to that mailbox will be rejected. Subscribers may not leave previously read or downloaded E-mail on our server for more than seven (7) days. Failure to adhere to this policy will result in suspension of E-mail service. Subscribers are urged to contact Technical Support if assistance is needed to properly configure E-mail programs.
- PLEASE READ BILLING DETAILS CAREFULLY: Subscribers will be billed in advance on a monthly basis, and payments by check, money order, cash and credit card are accepted. IMPORTANT NOTE: BILLING FOR DSL SERVICE COMMENCES WITH THE DATE OF ACTIVATION (THE DATE THE CIRCUIT BECOMES ACTIVE). For check, cash or money order payments, invoices will be sent via E-mail on the 15th day of every month and payment are due by the 1st day of the following month. Subscribers who wish to receive invoices via the Postal Service will be charged an additional $2.00 per month for handling. For subscribers who elect to pay by credit card, invoices will be generated and accounts will be credited on the 1st business day of every month. Any account which is not paid when due, regardless of the reason, will automatically be suspended, and finance charges will accrue. There will be no exceptions to this policy and no notice of suspension will be given. If payment is not received within three (3) days after the due date, the account will be terminated. If payment is received after termination, a $50.00 reactivation fee will be charged, and there may be a 15 day reactivation period. If a subscriber tenders a check that is returned for nonpayment, or if his/her credit card is declined, and the outstanding balance is not cleared by the first of the month, the suspension/termination process will commence, the subscriber will be denied access to the service, and an administrative fee of $20.00 will be assessed. If an overdue account is referred to our collection agency, all costs of collection will be added to the overdue amount. If subscriber supplies credit card information for billing purposes at any time during the service term, 99main reserves the right to process said card for any final balance due that remains unpaid after the account has been closed.
